Indonesia's Constitutional Court Sets Verdict on MBG Budget Lawsuit

TEMPO.CO, Jakarta The Indonesian Constitutional Court has scheduled a session to announce the verdict on the lawsuit over the Constitutional Court can be read on Thursday, July 30, 2026. The session for case number 55/PUU-XXIV/2026 will be held at 1:30 PM local time, as stated in the official announcement on the Constitutional Court's website on Wednesday, July 29, 2026.

The applicant's witness for case number 55/PUU-XXIV/2026, Iman Zanatul Haeri, confirmed the scheduled session. He obtained this information from the applicant of the case, Reza Sudrajat.

"We will be present at this crucial point," said the Head of Advocacy Division of the Association of Education and Teachers, when asked for confirmation via WhatsApp message on Wednesday, July 29, 2026.

Lawsuits challenging the state budget law related to the free nutritious meal program (MBG) have been filed by various civil society groups and other parties.

There have been six constitutional lawsuits submitted by civil society groups, educators, and students. These six lawsuits are registered under case numbers 40, 52, 55, 100, 130, and 142/PUU-XXIV/2026.

The majority of the challenged articles are related to Article 22 paragraph (3) of the state budget law and its explanations. This article stipulates that the education budget amounts to more than Rp769 trillion or 20 percent of the total state budget.

However, the issue lies in the allocation of a portion of these funds for the MBG project. Based on Presidential Regulation Number 188 of 2025, Rp223 trillion out of the Rp769 trillion education budget is designated for the National Nutrition Agency (BGN).

During the June 15, 2026 session, Iman, as a witness for the applicant, stated that the existence of the MBG project has had negative impacts on the careers and welfare of teachers in every group, including the termination of employment contracts.

"In Tuban, 39 contract teachers were terminated, and in various places such as Cianjur, East Lombok, and many others, there have been layoffs," said Iman.

He continued by stating that the negative impact of this flagship project of the Prabowo Subianto administration has also led to a decrease in income for teachers, especially part-time contract teachers (PPPK).

Iman provided examples, citing data compiled by P2G, showing that many teachers receive wages far below the standard of decency. In Langkat, North Sumatra, and Blitar, East Java, for instance, part-time contract teachers only receive a monthly salary of Rp500,000. "In Sumedang, West Java, it's Rp50,000," said Iman.

However, according to him, based on a survey conducted by P2G on 2,309 teachers in Indonesia, almost all of them expressed similar sentiments, stating that the presence of the MBG project has increased the workload of educators while reducing teaching hours.

Therefore, before the Assembly, Iman hopes that the constitutional judges will consider his testimony regarding the facts experienced by teachers after the implementation of the MBG project.

He reminded that the fourth amendment clearly stipulates that at least 20 percent of the education budget is intended for teacher welfare.

"So, we hope this is indeed for the teachers and should not be taken by the MBG," he said.
