
TEMPO.CO, Jakarta - The Judicial Commission of Indonesia has provided an update on suspected ethical violations by Pontianak High Court judges who acquitted Yu Hao, a Chinese national, in a case involving illegal gold mining in West Kalimantan. Spokesperson Mukti Fajar Nur Dewata stated that the commission has collected information and statements pointing to potential ethical breaches and misconduct by the judges, prompting the deployment of an investigative team.
However, Mukti withheld the investigation’s findings due to their confidential nature. "The findings will be discussed with KY members responsible for oversight," he said in a statement on Wednesday, May 21.
Earlier, the Pontianak High Court panel acquitted Yu Hao, who was charged with illegal gold mining. The panel consisted of presiding judge Isnur Syamsul Arif and associate judges Eko Budi Supriyanto and Pransis Sinaga.
This acquittal reversed the Ketapang District Court's decision, case number 332/Pid.Sus/2024/PN, issued on October 10, 2024. In that ruling, Yu Hao received a 3.6-year prison sentence and a Rp30 billion fine.
Prosecutors had charged Yu Hao with operating an illegal mining operation without a permit from February 2024 to May 2024, during which a 397.343-meter tunnel was excavated.
Yu Hao faced charges under Article 158 of Law No. 3 of 2009 on Mineral and Coal Mining, with a potential penalty of 5 years in prison and a Rp50 billion fine.
