Indonesia's DPR Faces Lawsuit Over Lifelong Pension Benefits

TEMPO.CO, Jakarta - Two plaintiffs have filed a lawsuit at the Constitutional Court seeking to remove members of the House of Representatives (DPR) from the list of pension recipients under Law Number 12 of 1980 on the Financial Rights Administration of State Officials and Members of State Institutions. The case is registered as 176/PUU-XXIII/2025.

The lawsuit was filed on September 30, 2025, by psychiatrist Lita Linggayani and student Syamsul Jahidin, who requested the Court to review Articles 1a, 1f, and 12 of the law.

In their petition, Lita argued that it is unfair for taxpayers like her to fund pensions for DPR members who served only five years but receive lifelong benefits.

“(Plaintiff I) is unwilling for their taxes to be used to pay pensions for DPR members who only served for five years but receive lifelong benefits and are transferable,” the formal petition stated, as cited on the Constitutional Court’s website on October 3, 2025.

Lita also noted that pensions for DPR members contribute to the state budget’s burden. According to their calculations, around 5,175 former DPR members have been entitled to pensions since the enactment of the law.

The issue echoes public demands made during the August demonstrations, when protesters called for the DPR to remove pension benefits as part of the 17+8 demands.

At that time, the DPR did not grant the request. The DPR has previously outlined pension amounts in a decision letter from a consultation meeting with faction leaders on September 4, 2025.

Under the law, DPR members who resign are entitled to a pension based on their length of service. Article 13, paragraph 2 states that the basic monthly pension equals 1 percent of the pension basis per month of service, with a minimum of 6 percent and a maximum of 75 percent.

As a result, pension amounts vary:

  • Rp3.6 million for members who served two periods

  • Rp2.9 million for members who served one period

  • Rp400,000 for those who served 1–6 months

Arif Adiputro, a researcher at the Indonesia Parliamentary Center, explained that former DPR members who served five years are entitled to 60 percent of their basic salary as a pension.

“This is 60 percent of the basic salary, not including allowances,” he said. For example, if the basic monthly salary is Rp4.2 million, the pension would be Rp2.52 million.

Pensions are lifelong, and in the event of a recipient’s death, their partner is entitled to half the pension, which can also be passed down to underage children.

While the amounts may seem modest compared to the full salaries members received while in office, Arif believes the lawsuit reflects a broader concern about fairness and social justice.

“The lifelong benefits for five years of work is the core of the lawsuit and a source of injustice in society,” he said.
