TEMPO.CO, Jakarta - The House of Representatives ratified the Fourth Amendment Bill to Law Number 4 of 2009 concerning Mineral and Coal Mining (Minerba Bill) into Law in the 13th Plenary Meeting of Session II at the DPR RI Building, Jakarta, Tuesday, February 18, 2025. Minister of Energy and Mineral Resources (ESDM) Bahlil Lahadalia claimed that this ratification was a strategic step to improve mining governance in Indonesia.
According to him, the government is targeting the mineral and coal sector to become the main driver of the economy, accelerate industrialization based on natural resources, and ensure more equitable benefits for the community. "This step is in line with the development priorities of the Red and White Cabinet as stated in Asta Cita, namely strengthening national independence through energy self-sufficiency, creative economy, green economy, and industrial downstreaming," said Bahlil in his speech delivering the Government's final opinion, Tuesday, February 18, 2025.
Bahlil assessed that this new regulation will increase the added value of the mining sector in the country, create jobs, and increase state revenues. "Most importantly, the benefits must be felt by all Indonesian people fairly and evenly," he said.
Concession Claims as Implementation of Article 33
On several occasions, Bahlil assessed that the granting of mining concessions that have recently become the center of discussion is an implementation of Article 33 of the 1945 Constitution. "I interpret this as a constitutional jihad in order to realize Article 33 of the 1945 Constitution, as often conveyed by President Prabowo Subianto," said Minister of Energy and Mineral Resources Bahlil Lahadalia in a Plenary Meeting at the DPR, Monday, February 17, 2025.
Bahlil claimed that the latest revision of the policy was actually to restore the mandate of Article 33 of the 1945 Constitution, with good intentions. "Which states that all wealth in our country, whether sea, land, and air, is controlled by the state. And used as much as possible for the benefit of the people," he said Thursday, January 30, 2025. "This is part of the retribution, not used as much as possible for the benefit of entrepreneurs, right?"
Previously, the Chair of the Legislative Body (Baleg) of the DPR, Bob Hasan, emphasized that all factions approved the Minerba Bill in the first level discussion, which was then passed during the Plenary Session. "From a total of eight factions, 100 percent approved this bill. This means that it can be submitted to the second level discussion in the Plenary Session of the DPR RI," he said.
