Indonesia Suspends 190 Mining Permits Over Reclamation Fund Violations

Indonesian coal production is still in accordance with the work plan of the mining permit holder. Data from the Directorate General of Mineral and Coal in 2018 noted that the Non-Tax State Revenue (PNBP) of Minerba was IDR 50 trillion, exceeding the target of IDR 32.1 trillion.

TEMPO.CO, Jakarta - Indonesian Ministry of Energy and Mineral Resources (ESDM) has suspended 190 mineral and coal mining business permits (IUP) after companies failed to meet their reclamation and post-mining payment obligations.

The decision is outlined in the Decree of the Director General of Minerals Number T-1533/MB.07/DJB.T/2025, issued on September 18, 2025.

The decree refers to Government Regulation No. 78/2010 on Reclamation and Post-Mining and Ministerial Regulation No. 26/2018 on Good Mining Practices, both of which require mining companies to provide reclamation and post-mining guarantees. Failure to comply allows the government to impose administrative sanctions ranging from written warnings and permit suspensions to full revocation.

“This is the result of a comprehensive evaluation conducted by the Directorate General of Minerals,” Deputy Minister of ESDM Yuliot Tanjung said during the 2025 Green Energy Summit in Jakarta on Tuesday, September 23.

Yuliot explained that the suspensions were not only tied to reclamation funds but also to broader compliance issues, including violations of the companies’ approved Work Plan and Budget (RKAB). Some firms, he noted, had produced beyond the capacity authorized by the government.

“As long as companies operate in line with their permits and business plans, there should be no problem. Unfortunately, in practice, several companies failed to comply,” he added.

On the possibility of reinstating the suspended permits, Yuliot said the decision would depend on further evaluations by the Directorate General of Minerals.

“We will review the findings. If companies are proven to have met their obligations, reinstatement can certainly be considered,” he said.
