
TEMPO.CO, Jakarta - Habiburokhman, a member of the House of Representatives and Chair of Commission III, said the discussion on the Criminal Procedure Code (KUHAP) Bill will be conducted transparently.
He explained that the bill has now reached the formulation and synchronization stage, handled by the working committee's formulating and synchronization teams.
The Gerindra Party politician emphasized his commitment to ensuring broad public involvement.
"We want transparency in this discussion process, unlike the discussions on other laws which are sometimes conducted in hotels and raise suspicions," said Habiburokhman, as quoted from a written statement on the House of Representatives website, Saturday, July 11, 2025.
He noted that the entire KUHAP discussion, including debates on the list of issues, is being broadcast live and can be accessed through the official House of Representatives YouTube channel.
However, he acknowledged technical challenges in uploading every article change in real time, as the renumbering and revision process by the formulating and synchronization teams remains complex.
"We cannot upload the changed articles directly because we are waiting for other articles to be combed through and reorganized," he said.
To enhance transparency, Habiburokhman stated that meetings of the formulating and synchronization teams, previously not publicly aired, are now required to be broadcast live.
He added that the bill's discussion has been open and involved various sectors of society. According to him, the Law Commission has gathered input from 53 groups with different backgrounds, which helped shape the 1,676 issues outlined in the list of issues for discussion with the government.
He rejected claims that the House’s promise of meaningful public participation in the KUHAP drafting process was just rhetoric. He invited the public to assess the process for themselves.
"The articles that are included are from the entire community. So, please let the public judge, whether we are the ones talking nonsense or they are," he said.
Deputy Minister of Law Edward Omar Sharif Hiariej, also known as Eddy, said that KUHAP Bill accommodates public interests. According to him, the ministry has held several discussions with stakeholders, including civil society groups. The results were used in preparing the bill’s list of issues.
"We had extraordinary discussions involving the public, starting from the civil society coalition, experts, and universities throughout Indonesia," Eddy said during a press conference at the Parliament Building in Senayan on Thursday, July 10, 2025.
Meanwhile, the House and the government have officially started the working committee meetings on the bill. According to Habiburokhman, the KUHAP Bill contains more than 334 articles covering 10 key areas.
Among these are aligning the KUHAP with new values in the revised Criminal Code, strengthening the legal rights of citizens, empowering the role of legal counsel, and refining rules on coercive measures.
The KUHAP revision will replace Law No. 8 of 1981, which has been in effect for about 44 years. The revision was initiated by the House and is listed as part of the 2025 Priority National Legislation Program (Prolegnas).
