Bangka Belitung Community Organization Files Report Against Harvey Moeis Over Alleged CSR Fund Embezzlement

Tempo.co, Pangkalpinang - The legal counsel for the community organization Laskar Pejuang Perkumpulan Putra Putri Tempatan Bangka Belitung, Andi Kusuma, has filed a report against Harvey Moeis with the Criminal Investigation Agency (Bareskrim) of the Indonesian National Police.

Harvey Moeis, a convict in a corruption case involving the tin commodity trade within the Mining Business License (IUP) area of PT Timah Tbk in 2015, is accused of embezzlement and fraud concerning the disbursement of Corporate Social Responsibility (CSR) funds. Moeis is also known as the husband of actress Sandra Dewi.

Andi Kusuma alleged that Harvey Moeis orchestrated CSR payments made by smelter companies implicated in the tin corruption case, which the Attorney General's Office later identified as misappropriated "security funds." "Beyond being a corporate obligation, the CSR payments made to Harvey Moeis, ranging from USD 500 to USD 750 per ton of tin between 2015 and 2022, were assumed by the smelter companies to be allocated for humanitarian purposes," Kusuma stated on Monday, January 20, 2025.

Andi Kusuma highlighted that one of the companies impacted by the CSR fund issue is PT Stanindo Inti Perkasa (SIP), a tin smelter company, which reportedly paid IDR 73.7 billion according to the management fee records.

"Following Harvey Moeis's instructions, the CSR funds were paid in USD and exchanged through PT Quantum Skyline Exchange. PT SIP was simply adhering to recommendations to process payments via PT Quantum Skyline Exchange. Therefore, implicating the smelter companies in this matter over the CSR funds is unwarranted," he explained.

Andi Kusuma revealed during the trial that Harvey Moeis was identified as the key figure responsible for the issue, acting as the initiator of the CSR funds.

"Tin smelter companies have been unjustly accused as if they were directly involved in the misuse of CSR funds. During a recent court session, the prosecutor disclosed that Harvey Moeis had exploited the CSR funds for purposes other than intended. The prosecutor claimed the funds were used for security purposes, but in reality, the smelters were completely unaware of the fund's misallocation," Andi explained.

He further stated that Harvey Moeis's actions led to the conviction of an individual and a corporation, which has had a significant negative impact on the people of Bangka Belitung, a region that depends heavily on tin production.

"The majority of residents in Bangka Belitung work in the mining sector. When companies face criminal charges, it results in mass layoffs, an economic downturn dropping to just 0.13 percent, a rise in unemployment, and a sharp decrease in purchasing power. These are not mere statements; these facts can be verified by the relevant authorities," he stressed.

In addition to Harvey Moeis, Andi Kusuma had also filed a report against two expert witnesses from IPB University, Bambang Hero and Basuki Wasis, with the police. Andi Kusuma represents Suwito Gunawan, also known as Awi, one of the individuals convicted in the tin case. Suwito was sentenced to eight years in prison.
